Dear Members,
Our Annual Meeting will be April 5th at Calusa Elementary School starting at 7:30 PM. Candidates for
election include members of the current Board of Directors, Tanya Gibson, Frank Yann, Bill Schira, and
our recently appointed Treasurer Ken Paulsen. In addition, Paul Duros has informed the Nominating
Committee that he intends to run for a Board position. We encourage you all to attend.
Our property values are continuing to rise. The goals for the new Board of Directors in the coming year
should be to improve communication, maintain a steady upgrade of the common area, review and negotiate
vendor contracts and our cable contract, establish a committee to review our declarations and bring
amendments back to the residents for a legitimate vote, and maintain the status quo in our community.
The legal issues are now behind us. With the conclusion of the Declaratory Judgment action we can go
forward and bring the illegal amendments of our declarations back to the community for a legitimate vote.
The Board has settled and dismissed its lawsuit against Cheryl Angelotti. Pheasant Walk recently took Ms.
Angelotti's deposition and she filed a motion for summary judgment and a motion for attorney fees, but
those motions had not yet been decided by the Court.
Pursuant to the settlement agreement, Traveler's Insurance Company has paid Pheasant Walk $ 2,500.00
under a policy insuring Pheasant Walk's former directors and officers. The settlement is not an indication
that either side admits any liability. Instead, the settlement reflects the Board's decision not to incur
additional attorney's fees and costs to pursue the lawsuit in light of the evidence and the fact that the lighting
and mailbox issues have largely been resolved within the community.
We want to remind our residents that crimes of opportunity can occur in any community when those
opportunities are made easy. Although Pheasant Walk has experienced very little criminal activity, please
remember to keep your car doors locked while parking overnight in your driveways. Close your garage
doors at night and lock your doors. Always drive carefully and observe all speed limits in our community.
