MANAGER’S REPORT
AUGUST 2003

I have been in communication with Katzman & Korr, the attorneys, regarding the Dec Action Pending. The Motion for Summary Judgement was filed and we are simply waiting for a judge to grant a hearing. Two outcomes can occur. The motion is granted and judge believes that the amendments were improperly adopted or the motion is denied and we proceed to trial. Mike Chapnick, the attorney on this case will try to speed up the hearing process.

The Pheasant Walk vs Angelotti suit is moving along. We have completed the discovery request from opposing counsel and we have submitted our request for discovery. Once we receive our discovery requests, the next step will be to start depositions.

Enclosed in your packet is a landscape proposal for the front entrance. Please note that there is an option to remove the Washintonias. This design will give the front entrance a much needed facelift.

I have sent a copy of the Adelphia contract to Katzman & Korr for review. Once reviewed, they will send a letter to Adelphia regarding the community channel.

We requested Palm Beach County a letter to allow us to remove the existing stop signs and place them on the new poles. Instead we received a final approval letter of the sign project. I have requested the letter to be issued for our records. A copy is attached for your review.

I have received a letter from Mr. Kaufman advising the Board that he would accept yearly payments of $150 in exchange for irrigation to the rear park entrance. A copy is attached for your review.
